MHI HOUSING ALERT: DOE Proposes Postponing Compliance Date of Manufactured Housing Energy Standards

Source: MHI Housing Alert – March 17, 2023 – The United States Department of Energy (DOE) has released a notice of proposed rulemaking (NOPR) to amend the compliance date for its manufactured housing energy standards, which were set to go into effect on May 32, 2023. According to the NOPR, the delay is intended to allow the DOE additional time to establish enforcement procedures.

 

The DOE is proposing to extend the compliance date for manufactured housing energy standards until DOE’s future enforcement procedures take effect. In particular:

  • DOE is proposing to require compliance with the Tier 1 (single section home) standards 60 days after the publication of its final enforcement procedures.
  • DOE is proposing to require compliance with the Tier 2 (multi-section home) standards 180 days after the publication of its final enforcement procedures.

 

The Manufactured Housing Institute (MHI) expects the DOE NOPR to formally be published in the Federal Register in the coming weeks. Once it is published, members of the public will have 30 days to submit comments on the proposal. MHI intends to submit comments in support of the compliance delay. We will also activate a grassroots advocacy campaign to facilitate the submission of as many comments from MHI members and other industry stakeholders as possible.

Today’s NOPR comes on the heels of MHI’s lawsuit against the DOE and its multi-pronged advocacy strategy to address the problems posed by the rule. MHI is in favor of the standards proposed by the Manufactured Housing Consensus Committee (MHCC), which are currently under consideration by HUD. HUD is expected to issue a notice of proposed rulemaking on its energy standards some time in June 2023. MHI is also pursuing a legislative solution to make HUD (with the collaboration of the MHCC) the primary regulator for manufactured housing energy standards.
